A RESOLUTION AUTHORIZING ACCEPTANCE OF 2025 DONATIONS
WHEREAS, the City of Kenyon received various donations in the amount of $45,488.23
in 2024; and
NOW THEREFORE, BE IT RESOLVED, that the City of Kenyon authorizes the
acceptance of 2024 donations in the amount of $25,729.47.

A RESOLUTION TO ESTABLISH LICENSE FEES AND COMPENSATION
WHEREAS, Section 1000.03 of the Kenyon City Code provides that license fees for licenses
and compensation not specifically set by the Code, shall be fixed and determined by resolution of the
City Council.

Pursuant to due call and notice thereof, a City Council Meeting was duly held in the City Council chambers
at 7:00 p.m. on the 9th day of December 2025. The meeting was called to order by Acting Mayor Mary
Bailey

ENGINEERING
2025 Street and Utility Improvements
Engineer Olinger reported that Fitzgerald has completed work for this year. The project will be finished
in 2026. Pay application No. 4 includes work from November 1 to November 28 in the amount of
$220,801.37.
Fitzgerald Excavating and Trucking Change Order No. 1
Engineer Olinger stated that a change order was being done to clean up some administrative changes. It
was not quite ready yet, so it was tabled.
2025 Street and Utility Improvements – Fitzgerald Excavating & Trucking -Pay Application No. 4
Motion by Sjolander seconded by Bailey to approve pay application #4 to Fitzgerald Excavating in the
amount of $220,801.37. Motion carried 4-0-0.
LEGAL
Ordinance No. 113: Regulating the Discharge of Firearms, Bows, and Hunting Within City Limits
Attorney Riggs reviewed Ordinance No. 113, which adds a section to the city code regulating the
discharge of firearms, bows, and hunting within city limits. The revised ordinance incorporates changes
discussed at the previous meeting.
Motion by Helgeson seconded by Sjolander to adopt Ordinance No. 113. Motion carried 4-0-0.

Motion by Helgeson seconded by Brunner to adopt Resolution 2025-25. Motion Carried 4-0-0.
MN Paid Leave Policy
Attorney Riggs reviewed a draft Minnesota Paid Leave Policy based on the League of Minnesota Cities model. The
City is required to have a policy in place for the new state paid leave program.
Motion by Sjolander seconded by Helgeson to approve the MN Paid Leave Policy, with staff authorized
to make necessary changes. Motion carried 4-0-0.
Firebird LLC Contract
Attorney Riggs stated that the EDA approved a purchase and development agreement with Firebird, LLC for a lot
in the Kenyon Industrial Park and recommended Council approval.
Motion by Sjolander, seconded by Bailey, to approve the purchase and development agreement with Firebird, LLC.
Motion carried 4-0-0.
Power Sales Agreement
Attorney Riggs reported that the KMU Commission recommended approval of a power agreement with
CMPAS to purchase one-half megawatt of wind energy, with the option to purchase an additional one-
half megawatt if available.
Resolution 2025-31 Authorizing the Execution of Bingham Lakes Facility Wholesale Power Agreement
Motion by Helgeson seconded by Brunner to adopt Resolution 2025-31. Motion carried 4-0-0.
FINANCIAL
OLD BUSINESS
2026 Budget and Levy
Resolution 2025-29: Adopting the 2026 Budget and Establishing the Tax Levy for Payable 2026
Administrator Lehner reported that the Truth in Taxation hearing was held on December 2. The final
budget reflects a maximum proposed levy increase of 9.18 percent for 2026.
Motion by Bailey second by Helgeson to adopt Resolution 2025-29 adopting the 2026 budget and
establishing the tax levy of $1,528,541 payable in 2026. Motion carried 4-0-0.
Approve posting the Line Worker/Water Operator Position
Administrator Lehner stated that the KMU Commission recommended posting the Line Worker/Water
Operator position to replace Austin Fitch, who resigned in May.
Motion by Sjolander, seconded by Brunner, to approve posting the Line Worker/Water Operator
position. Motion carried 4-0-0.
NEW BUSINESS
CEDA 2025 Contract
Administrator Lehner reported that the City’s contract with CEDA is up for renewal. The EDA
recommended approving the CEDA contract for contracted services totaling $55,053 annually for two
days per week.
Motion by Bailey seconded by Brunner to approve the 2026 CEDA contracted services.
Motion carried 4-0-0.
Resolution 2025-30: A Resolution Committing Capital Fund Balance
Administrator Lehner explained that Governmental Accounting Standards Board (GASB 54) requires
public entities to commit year-end capital fund balances prior to year end, contingent upon audited final

Administrator Lehner reported that MMUA is offering a Governance in Action training conference for

not see it as beneficial for the council members to attend. Estimated cost is approximately $600 per
attendee.
Motion by Sjolander seconded by Helgeson to approve the KMU Commissioners attend this conference.

Administrative Policy #39: Paid Time Off Cash-Out
Administrator Lehner stated that the proposed policy would allow employees to cash out PTO balances
exceeding 80 hours at year end.

Auditing Services RFP
Administrator Lehner reported that two proposals were received for auditing services. The City’s current
auditor, ABDO, is no longer able to perform the audit due to its role in providing finance services.
BerganKDV proposed fees of $27,540 for the first year, increasing to a maximum of $29,500 by the
third year. CliftonLarsonAllen proposed fees of $97,640 for the first year, increasing to $70,940 by the
third year.
Motion by Sjolander seconded by Brunner to accept the proposal from BerganKDV with the option to
reevaluate the contract after one year. Motion carried 4-0-0.
Holiday Office Closings
Administrator Lehner requested approval for City Offices and Library to be closed Wednesday, December 24
and Friday, December 26.

cancelling service in Kenyon as of January 1.
Police Chief Sjoblom thanked the public for their local donations.
Brady Fischer questioned what was going on with police officer Homeier. Lehner stated that Homeier is
currently on administrative leave.
Fischer also asked where his utility money goes. Council member Sjolander offered to get a list from him
and find answers. The KMU staff also talked with Fischer after the meeting.

Change order #1 was removed from last month’s agenda, but it is
now ready for review.
This is a contract amendment to address two items on the project
1. Completion dates for 2025 work are extended to reflect the
additional time needed to complete the 2nd street watermain
work and other work completed during the 2025 construction
season. This change effectively removes the liquidated
damages that would otherwise be assessed to the contractor. In
this case, we feel that the assessment of liquidated damages
would not be appropriate.
2. The total payment for the 2nd Street watermain work is revised.
The original contract required this work be completed using
trenchless/drilling techniques and limiting the time of closure
for 2nd street/County Rd 12. Subgrade soil/rock conditions
prevented this; so, the pipe was installed using traditional open-
trench construction. Although this work was more disruptive
and total time for the street closure was extended by several
weeks, the true construction cost results in a net deduct of
~$38,000.

The following changes bring contract time requirements in line with actual completion
dates, effectively eliminating any liquidated damages due. The second item adjusts the contract
amount to reflect the final amount due to the contractor.
In an effort to define completion expectations, the provisions described below are added to the
contract (deleted text crossed out, new text in bold italics):
Project Manual Revisions
1. Modify the following to Section 00 52 00 – Agreement Forms, Article 4.05.A.4 and 4.05.A.5,
as follows:
4. Milestone 1D (2nd street): any work requiring continuous closure and detour of CSAH
12, exclusive of concrete & paving, is limited to 7 working days or less. Closure may be
extended to 11 working days (total) if final paving and concrete is scheduled
immediately after utility work. Milestone 1D for 2nd Street no longer applies.
5. Milestone 2A (Semi-Final): This milestone (2A) only applies to major portions of work
started in 2025. All work, except for the final lift of bituminous pavement on new streets
and mill & overlaying Forest Street and other work directly related to final paving, must
be substantially completed on or before October 31 November 28, 2025. The final
paving exception does not apply to localized patching.
1) Milestone 2A does not apply to trenchless sanitary sewer improvements (i.e.
CIPP lining, service grouting, manhole rehabilitation). No other interim
milestones, nor winter work restrictions apply to trenchless sanitary
improvements. The requirements of 4.04 of the Agreement still apply to this
work. (Addendum No. 1)
2. Refer to Work Change Directive 1 for plan revisions associated with the 2nd Street Watermain
(attached – with updated plans and cost summary). This change order is intended to settle
the payment difference between the bid 2nd Street work and work actually completed.

Description:
The original bid design for new watermain within 2 nd street was for 10” diameter
watermain and related improvements, installed using primarily horizontal directional drilling
methods. Shallow bedrock was discovered on the east end of 2 nd St (between ~305+00 and ~309+00)
was discovered during investigatory excavations. Based on this information, it is believed that the
watermain can most cost effectively installed using open trench methods.
The attached plan sheets illustrate changes to the bid plan which will accommodate open
trench installation of piping. Following review of anticipated pricing, no increase to the overall
contract price is anticipated. An unofficial estimate is provided for reference alone.
At this time, it is the intent to substantially complete all 2 nd Street work in 2025. Some
reasonable time extensions may be made later via change order, if necessary to accommodate the
revised work plan.

STATE OF MINNESOTA
A RESOLUTION EXPRESSING THE CITY OF KENYON’S WILLINGNESS
TO WORK WITH REBOUND REAL ESTATE ON TAX INCREMENT
FINANCING (TIF) FOR THE SUNSET HOMES REDEVELOPMENT
WHEREAS, the former Sunset Homes site located at 127 Gunderson Boulevard presents environmental
and financial challenges that hinder private redevelopment without public assistance; and
WHEREAS, Rebound Real Estate has proposed redevelopment of the site in a manner consistent with
the City of Kenyon’s comprehensive planning, housing, and economic development goals; and
WHEREAS, Tax Increment Financing (TIF) is a redevelopment tool authorized under Minnesota law
to assist in addressing extraordinary costs, including environmental remediation and site preparation.
NOW, THEREFORE, BE IT RESOLVED that the City of Kenyon (“City”) expresses its willingness
to work cooperatively with Rebound Real Estate to evaluate the potential use of Tax Increment Financing
or other lawful redevelopment tools to support the Sunset Homes redevelopment project.
BE IT FURTHER RESOLVED that this resolution does not obligate the City to establish a TIF district
or provide financial assistance, but rather affirms the City’s intent to participate in good-faith discussions
and analysis of redevelopment financing options as the project advances.
BE IT FURTHER RESOLVED that the City finds such cooperation to be in the public interest as it
may result in:
Removal of blight and environmental risk
Expansion of the local tax base
Increased housing supply
Long-term economic growth for the community
NOW, THEREFORE BE IT FINALLY RESOLVED that the Mayor and the City Administrator, are
hereby authorized to execute such agreements as are necessary to implement the project on behalf of the
applicant.
The above resolution was adopted by the City Council of the City of Kenyon on January 13, 2026.

COMMITTING THE LOCAL MATCH AND AUTHORIZING CONTRACT SIGNATURE
BE IT RESOLVED that the City Council of the City of Kenyon, MN, has approved the Redevelopment
Grant application submitted to the Department of Employment and Economic Development (DEED) on
_____________, 2026, by the City of Kenyon for the former Kenyon Sunset Home site at 127 Gunderson
Boulevard.
BE IT RESOLVED that the City of Kenyon will act as the legal sponsor for project(s) contained in the
Redevelopment Grant Program application to be submitted on __________________, 2026, and that
Kenyon City Administrator is hereby authorized to apply to the Department of Employment and Economic
Development for funding of this project on behalf of the City of Kenyon.
BE IT FURTHER RESOLVED that the City of Kenyon has the legal authority to apply for financial
assistance, and the institutional, managerial, and financial capability to ensure adequate project
administration.
BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the application
are committed to the project identified.
BE IT FURTHER RESOLVED that if the project identified in the application fails to substantially provide
the public benefits listed in the application within five years from the date of the grant award, the City of
Kenyon may be required to repay 100 percent of the awarded grant per Minn. Stat. § 116J.575, Subd. 4;
BE IT FURTHER RESOLVED that the City of Kenyon has not violated any Federal, State, or local laws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt
practice.
BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Kenyon may
enter into an agreement with the State of Minnesota for the above-referenced project(s), and that the City
of Kenyon certifies that it will comply with all applicable laws and regulation as stated in all contract
agreements.
NOW, THEREFORE BE IT FINALLY RESOLVED that the Mayor and the City Administrator, are hereby
authorized to execute such agreements as are necessary to implement the project on behalf of the applicant.

331A.04 DESIGNATION OF A NEWSPAPER FOR OFFICIAL PUBLICATIONS.
Subdivision 1. Priority. The governing body of a political subdivision, when authorized or required by
statute or charter to designate a newspaper for publication of its public notices, shall designate a qualified
newspaper in the following priority.
Subd. 2. Known office in locality. If there are one or more qualified newspapers, the known office of
issue of which are located within the political subdivision, one of them shall be designated.
Subd. 3. Secondary office in locality. When no qualified newspaper has a known office of issue located
in the political subdivision, but one or more qualified newspapers maintain a secondary office there, one of
them shall be designated.
Subd. 4. General circulation in locality. When no qualified newspaper has its known office of issue
or a secondary office located within the political subdivision, then a qualified newspaper of general circulation
there shall be designated.
Subd. 5. Other situations. If a political subdivision is without an official newspaper, or if the publisher
refuses to publish a particular public notice, matters required to be published shall be published in a newspaper
designated as provided in subdivision 4. The governing body of a political subdivision with territory in two
or more counties may, if deemed in the public interest, designate a separate qualified newspaper for each
county.
Subd. 6. Exception to designation priority. (a) Notwithstanding subdivisions 1 to 3, the governing
body of a political subdivision may designate any newspaper for publication of its official proceedings and
public notices, if the following conditions are met:
(1) the newspaper is a qualified medium of official and legal publication;
(2) the publisher of the newspaper furnishes a sworn statement, verified by a recognized independent
circulation auditing agency, covering a period of at least one year ending no earlier than 60 days before
designation of the newspaper, stating that the newspaper's circulation reaches not fewer than 75 percent of
the households within the political subdivision;
(3) the newspaper has provided regular coverage of the proceedings of the governing body of the political
subdivision and will continue to do so; and
(4) the governing body votes unanimously to designate the newspaper.
(b) If the circulation of a newspaper designated under this subdivision falls below 75 percent of the
households within the political subdivision at any time within the term of its designation as official newspaper,
its qualification to publish public notices for the political subdivision terminates.
Subd. 7. Joint bidding. A bid submitted jointly by two or more newspapers for the publication of public
notices must not be considered anticompetitive or otherwise unlawful if the following conditions are met:
(1) all of the qualified newspapers eligible for designation participate in the joint bid;
(2) the existence of the joint bid arrangement is disclosed to the governing body of the political subdivision
before or at the time of submission of the joint bid; and

(3) the governing body is free to reject the joint bid and, if it does, individual qualified newspapers do
not refuse to submit separate bids owing to the rejection of the joint bid.
