The final budget reflects a maximum proposed levy increase of 9.18 percent for 2026.

Presented with Resolution 2025-29 after the December 2 Truth in Taxation hearing.

At the meetingResolution 2025-29 adopted 4-0-0.

Answered from our records

The certified 2026 city levy is $1,528,541, which is 9.18 percent above the $1,400,000 levy for 2025, so the figure presented to the council is exact. The certified city tax rate rose to 84.6822 percent of net tax capacity from 79.3028 percent, and city tax billed across all city parcels for pay 2026 came to $1,504,110. The rate rise came almost entirely from the bond levy: the general rate fell 0.38 percent while the bond rate rose 35.91 percent.

BerganKDV proposed fees of $27,540 for the first year, increasing to a maximum of $29,500 by the third year. CliftonLarsonAllen proposed fees of $97,640 for the first year, increasing to $70,940 by the third year.

Report on the two responses to the auditing services RFP.

At the meetingCouncil accepted BerganKDV.

Answered from our records

Our bid record carries the same figures: BerganKDV at $27,540 to a maximum $29,500, CliftonLarsonAllen at $97,640 to $70,940. CliftonLarsonAllen's first-year price was 3.5 times BerganKDV's, and its schedule falls rather than increases across the three years, so the word increasing in the minutes describes a declining fee.

The minutes describe CliftonLarsonAllen's fee as increasing from $97,640 to $70,940 by year three, which is a decrease of $26,700.

The EDA recommended approving the CEDA contract for contracted services totaling $55,053 annually for two days per week.

EDA recommended renewing the city's contract with CEDA for 2026.

At the meetingMotion to approve the 2026 CEDA contracted services carried 4-0-0.

Answered from our records

The CEDA agreement in the same packet confirms the figure and restates the hours differently. It obliges the authority to reimburse CEDA for staff time at a not-to-exceed rate of $55,053 based on an average of sixteen hours a week, prorated if the start date shifts, with materials, conferences and meetings paid separately on a unit basis agreed in writing. Sixteen hours a week is the two days per week reported to the council. The work covered is economic development marketing, business outreach, business retention and expansion, and hosting public forums on the authority's programming.

QuestionBrady Fischer, citizen
Brady Fischer questioned what was going on with police officer Homeier. Lehner stated that Homeier is currently on administrative leave.

Asked during council and staff general comments, following a closed session on law enforcement personnel misconduct allegations.

At the meetingLehner said Homeier is currently on administrative leave.

What happened next

Brian Homeier resigned effective January 28 2026 and the city accepted a separation agreement. Attorney Riggs told the council a closed session was no longer necessary and he and Administrator Lehner recommended approving the resolution on the separation of Homeier's employment. A special closed meeting had been noticed for January 28 2026 under Minnesota Statutes section 13D.05 subdivision 2(b) to consider allegations against him.

The council closed the meeting from 6:12 to 6:49 pm to discuss internal affairs data and took no vote afterward.

What happened next

The matter ended in a resignation rather than a disciplinary decision. Brian Homeier submitted his resignation effective January 28 2026 and the council accepted a separation agreement, with Attorney Riggs advising that a further closed session was not necessary. No internal affairs investigation report appears in our record.

What happened next

The position was filled by Parker Burdorf, whose hire appears on the June 9 2026 council agenda and was approved on the July 14 2026 consent agenda 5-0-0, with Burdorf introducing himself at that meeting. The posting itself lagged: on April 12 2026 Administrator Lehner reported he was still working with KMU staff to update the job description and that the position should be posted soon. That is roughly a year between Austin Fitch's May 2025 resignation and the replacement hire.

The council directed the posting on December 9 2025, yet on April 12 2026 the administrator reported the job description was still being updated and the position not yet posted.

What happened next

Change Order No. 1, approved in early 2026, extended the 2025 completion dates, and Change Order 2 dated July 14 2026 sets substantial completion at July 18 2026 and ready for final payment at August 30 2026. Change Order 2 also delays final paving on 8th Street because soils backfilled over 2025 utility trenches settled over the following year. What happened next

The council approved Change Order No. 1 for Fitzgerald Excavating and Trucking 5-0-0 on a motion by Bailey seconded by Brunner, so no liquidated damages were assessed. The Change Order 2 form confirms the milestone changes carried by the first change order: Milestone 1D omitted and Milestone 2A pushed from October 31 to November 28 2025. Resolution 2025-30 commits year-end capital fund balances under GASB 54 before year end.

At the meetingCouncil adopted Resolution 2025-30 committing the balances subject to audit.

Partly answered

The 2025 audit had not produced final figures three months later: the February 10 and March 10 2026 packets still present unaudited cash balances by fund for September 30 2024, December 31 2024 and September 30 2025. The committed capital fund balances adopted under Resolution 2025-30 therefore remained contingent through at least March 10 2026. The completed 2025 audit report from BerganKDV would settle it.

The City's current auditor, ABDO, is no longer able to perform the audit due to its role in providing finance services.

Explanation for why the city issued an auditing services RFP.

At the meetingStated as the reason for the RFP.

Partly answered

The sequence in our bid record is consistent with the independence explanation: Abdo won the finance and accounting services RFP on August 12 2025 and the auditing services work then went to BerganKDV. Abdo has since proposed $164,800 for 2027 financial, HR and payroll services and charged a one-time $15,000 to reconcile January through July 2025 records. We hold no written independence determination or notice from Abdo, which is what would settle the stated reason.

AGENDA ITEM NO. VII.A

Agenda Item Summary

CITY COUNCIL AGENDA ITEM REPORT

DATE: January 13, 2026
SUBMITTED BY: Holli Gudknecht, Engineering
ITEM TYPE: Engineering

Agenda Section: Engineering

SUBJECT: 2025 Street & Utility Improvements - Change Order 1

Suggested Action:

Change order #1 was removed from last month's agenda, but it is now ready for review.

This is a contract amendment to address two items on the project

1. Completion dates for 2025 work are extended to reflect the additional time needed to complete the 2nd street watermain work and other work completed during the 2025 construction season. This change effectively removes the liquidated damages that would otherwise be assessed to the contractor. In this case, we feel that the assessment of liquidated damages would not be appropriate. 2. The total payment for the 2nd Street watermain work is revised. The original contract required this work be completed using trenchless/drilling techniques and limiting the time of closure for 2nd street/County Rd 12. Subgrade soil/rock conditions prevented this; so, the pipe was installed using traditional open- trench construction. Although this work was more disruptive and total time for the street closure was extended by several weeks, the true construction cost results in a net deduct of ~$38,000.

CHANGE ORDER FORM NO.: 1 Owner: City of Kenyon Owner's Project No.: Engineer: Bolton & Menk Engineer's Project No.: 24X.134934.000 Contractor: Fitzgerald Excavating & Trucking Inc. Contractor's Project No.: Project: 2025 Street & Utility Improvements Contract Name: N/A Date Issued: 1/13/2026 Effective Date of Change Order: 1/13/2026 The Contract is modified as follows upon execution of this Change Order: Description: The following changes bring contract time requirements in line with actual completion dates, effectively eliminating any liquidated damages due. The second item adjusts the contract amount to reflect the final amount due to the contractor. In an effort to define completion expectations, the provisions described below are added to the contract (deleted text crossed out, new text in bold italics): Project Manual Revisions 1. Modify the following to Section 00 52 00 – Agreement Forms, Article 4.05.A.4 and 4.05.A.5, as follows: 4. Milestone 1D (2nd street): any work requiring continuous closure and detour of CSAH 12, exclusive of concrete & paving, is limited to 7 working days or less. Closure may be extended to 11 working days (total) if final paving and concrete is scheduled immediately after utility work. Milestone 1D for 2nd Street no longer applies. 5. Milestone 2A (Semi-Final): This milestone (2A) only applies to major portions of work started in 2025. All work, except for the final lift of bituminous pavement on new streets and mill & overlaying Forest Street and other work directly related to final paving, must be substantially completed on or before October 31 November 28, 2025. The final paving exception does not apply to localized patching. 1) Milestone 2A does not apply to trenchless sanitary sewer improvements (i.e. CIPP lining, service grouting, manhole rehabilitation). No other interim milestones, nor winter work restrictions apply to trenchless sanitary improvements. The requirements of 4.04 of the Agreement still apply to this work. (Addendum No. 1) 2. Refer to Work Change Directive 1 for plan revisions associated with the 2nd Street Watermain (attached – with updated plans and cost summary). This change order is intended to settle the payment difference between the bid 2nd Street work and work actually completed. a. A summary of bid Work value and Actual/Completed Work Value is provided below. A detailed tabulation of thee contract values is attached for reference i. Bid Work Contract Value = $335,152* ii. Actual Work Value = $297,338* iii. Difference in Value= $ (37,814) iv. *A tabulation of these values is attached, titled "2 nd Street Watermain Revisions – Final Cost Summary". Owner: City of Kenyon Owner's Project No.: N/A

Engineer: Bolton & Menk Engineer's Project No.: 24X.134934.00 Contractor: Fitzgerald Excavating & Trucking Inc. Contractor's Project No.: N/A Project: 2025 Street & Utility Improvements Contract Name: N/A Date Issued: 10/06/2025 Effective Date of Work Change Directive: 10/06/2025

Contractor is directed to proceed promptly with the following change(s):

Description: The original bid design for new watermain within 2 nd street was for 10" diameter watermain and related improvements, installed using primarily horizontal directional drilling methods. Shallow bedrock was discovered on the east end of 2 nd St (between ~305+00 and ~309+00) was discovered during investigatory excavations. Based on this information, it is believed that the watermain can most cost effectively installed using open trench methods. The attached plan sheets illustrate changes to the bid plan which will accommodate open trench installation of piping. Following review of anticipated pricing, no increase to the overall contract price is anticipated. An unofficial estimate is provided for reference alone. At this time, it is the intent to substantially complete all 2 nd Street work in 2025. Some reasonable time extensions may be made later via change order, if necessary to accommodate the revised work plan. Attachments: Revised Plan sheets C4.03, C4.04, C5.01, C7.03, C 7.04, marked "WCD-1", dated 10/06/2025 Cost Estimate (unofficial, not intended to revise contract price)

Purpose for the Work Change Directive: Allow for open cut installation of watermain within 2nd Street.

Directive to proceed promptly with the Work described herein, prior to agreeing to change in Contract Price and Contract Time, is issued due to: ☐ Non-agreement on pricing of proposed change. ☒ Necessity to proceed for schedule or other reasons. Some minor adjustment to contract price and timelines expected at later date. Contract not anticipated to increase in price.

Estimated Change in Contract Price and Contract Times (non-binding, preliminary):

Contract Price: $ No Change (final price to be determined) Contract Time: N/A days Refer to CO-1 Minor time extension may be required to accommodate change in work plan.
