NOTICE IS HEREBY GIVEN that the City Council will hold a Special Meeting pursuant to
Minnesota Statutes, Section 13D.04, subdivision 2 on Monday, May 18, 2026, commencing at
6:00 p.m. at City Hall, 709 2nd Street, Kenyon, Minnesota for the following purposes:

      1.     Presentation, review and discussion of tax increment and financing issues for the
             Kenyon Real Estate 2 LLC “Sunset Homes” redevelopment project.

      2.     Other project-related matters.

      3.     Council Member Bailey Resignation
             a. Resolution 2026-17: Declaring a Vacancy to Exist in the Office of City

                                       CITY OF KENYON
                                     COUNTY OF GOODHUE
                                     STATE OF MINNESOTA

                RESOLUTION DECLARING A VACANCY TO EXIST IN THE
                 OFFICE OF CITY COUNCIL AND PROVIDING FOR THE
                             APPOINTMENT THEREOF

       WHEREAS, Council Member Mary Bailey has tendered her resignation to the City of
Kenyon City Council by letter effective December 31, 2026, such letter being set forth on
Exhibit “A”; and

        WHEREAS, the City Council must determine and declare whether or not a vacancy
exists on the city council; and

        WHEREAS, Minn. Stat. Section 412.02, Subd. 2a. states that when a vacancy in an elected
office of the City occurs before the first day to file affidavits of candidacy for the next regular City
election and more than two years remain in the unexpired term of the office, a special election shall
be held at the next regular City election and the appointed person shall serve until the qualification
of a successor elected at a special election to fill the unexpired portion of the term; and

        WHEREAS, in the City Council office to be declared vacant, more than two years remain
in the unexpired term of the vacated office; and

        WHEREAS, the City Council desires to fill the vacated office by council appointment
until the next regular city election.

        NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Kenyon, that
the City Council declares a vacancy to exist in the office of the City Council by virtue of Council
Member Mary Bailey’s resignation submitted in writing to the City.

       BE IT FURTHER RESOLVED, that pursuant to Minn. Stat. Section 412.02, Subd. 2a., the
Councilwill fill by appointment a successorto serve the remainder of the unexpired term of Council
Member Mary Bailey, until a special election for the office is held at the next regular City election
in 2026.

Dear Mayor, Council Members and City Administrator,

Please accept this as my formal resignation from the City Council of Kenyon effective 12/31/26

There are coming changes to my career and in my family and I will be unable to fulfill my responsibilities
as a council member for my remaining 2 years. I am hoping to leave enough time between now and the
next election cycle for replacement.

I am so grateful for the knowledge and friendships I have acquired while being able to serve my
community. I wish the council and the community growth and prosperity in the future. It has been a
privilege to work with you all.
